MINIMUM ORDER

Minimum order amount is twenty-five dollars ($25).   A ten dollar ($10.00) processing fee will be charged on all sales under $151.  This allows us to partially cover the cost of processing these small orders.

DATA INSTRUMENTS, INC LIMITED WARRANTY

DATA INSTRUMENTS warrants the Equipment (enclosed) to meet the eligibility of the original equipment manufacturer's standard maintenance contract at the time of shipment.

DATA INSTRUMENTS further warrants the Equipment to be free from defects in material and workmanship, considering normal use and service, providing the Equipment is installed by DATA INSTRUMENTS, the manufacturer, a manufacturer agent or an approved third-party maintenance provider. The DATA INSTRUMENTS Limited Warranty starts from the date of shipment, and expires after 30, 90, 180 or  365 days as stated on invoice, or at the time the equipment is placed under a manufacturer or other maintenance contract, whichever occurs earlier. Said warranty is limited, at the sole discretion of DATA INSTRUMENTS, to repair or replacement of the defective part (s), provided the Equipment is returned to DATA INSTRUMENTS, freight prepaid, for inspection and approval. DATA INSTRUMENTS must be notified of any Equipment malfunction immediately and, in the event of on-site repair is necessary, must initiate the request for service and approve all applicable charges.

No Items may be returned directly to DATA INSTRUMENTS without first contacting DATA INSTRUMENTS for a Return Authorization (“RMA”) number. If it is determined that the Item is defective, you will be given an RMA number and instructions for returning the Item. Any Items shipped without DATA INSTRUMENTS’ prior authorization will be returned to you and at your expense. Authorized Items are to be shipped prepaid and insured in an approved shipping container. The original box and packaging material should be kept for storing and shipping the Item.  

This Limited Warranty excludes equipment which has been handled or installed without acceptable electrostatic discharge protection or determined by DATA INSTRUMENTS to have been abused, misused, altered, neglected, improperly installed or damaged in shipment. Charges associated with the repair or replacement of abused, misused, altered, neglected or improperly installed equipment will be the responsibility of the customer.

This Limited Warranty excludes items not purchased directly from DII.

Advance Replacement Warranty:  This is a warranty upgrade.  All items being replaced under an Advance Warranty Replacement must be returned within 10 days.  After 10 days the item will not be accepted by Data Instruments and the Buyer will be charged for the full cost of the replacement and all shipping and insurance costs.

All items are shipped FOB Origin. Data Instruments is not liable for any freight damages or for reporting and filing insurance claims. Please contact the freight carrier to report all freight damage immediately. Keep all packing materials.

This Limited Warranty excludes Equipment for which payment has not been made in accordance with agreed upon terms, or equipment which has been offered "as is".

Any software and licensing will be subject to the Buyer’s separate license agreement with the owner, the distributor and/or manufacturer (“licensor”). The Buyer must comply with all terms and conditions set forth except as the agreement may conflict with the terms of this Agreement. DATA INSTRUMENTS does not does not provide or warranty any software or licenses.

THE EXPRESS WARRANTIES HEREIN CONTAINED ARE IN LIEU OF ANY AND ALL WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY AND WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. PURCHASER ACKNOWLEDGES THAT IT IS NOT RELYING UPON DATA INSTRUMENT'S SKILL OR JUDGEMENT TO SELECT OR FURNISH GOODS SUITABLE FOR ANY PARTICULAR PURPOSE AND THAT THERE ARE NO WARRANTIES WHICH ARE NOT CONTAINED IN THIS LIMITED WARRANTY. DATA INSTRUMENTS SHALL NOT BE LIABLE FOR DAMAGES, INCLUDING SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, ARISING OUT OF OR IN CONNECTION WITH THE PERFORMANCE OF THE EQUIPMENT OR ITS USE BY THE PURCHASER.

Products Offered

Unless specifically stated as "New" or "Unused", Data Instruments is offering to sell pre-owned computer hardware only. The Buyer is responsible for all costs associated with transportation, insurance, installation, software, licensing and applicable taxes. Products and pricing are subject to change without notice. Data Instruments is not responsible for inaccurate information, errors, omissions or product fitness for any particular use. System prices do not include licenses or software.

Terminology

"New"  hardware is shipped in the original shipping container with the original manufacturer's warranty or a one year Data Instruments’ warranty.  Also called NIB (New in Box).

"Unused"   hardware has never been used or has been taken out of the original shipping container for testing and  then returned to the original container.  It does not have the original manufacturer's warranty.  This can also be considered "Like New" or NOB (New Open Box)

"Pre-owned"   hardware has been placed into service or hardware that cannot be verified as being new or unused such as a part that is not in the original packaging or shipping container.

"New-Pull"   We don't sell these. Why? There is no way to determine whether the item is actually new and still covered under the manufacturer’s warranty or is years old but in great shape.

DATA INSTRUMENTS, INC. INVOICE

Data Instruments, Inc., agrees to sell the goods set forth on the front side of this document under the following terms and conditions.

PRODUCTS OFFERED:  Unless specifically stated in writing, Data Instruments is offering to sell pre-owned HARDWARE ONLY.  BUYER is responsible for all costs associated with transportation, insurance, installation, software, licensing and taxes.

OFFER: All descriptions, quotations, proposals, offers, acknowledgments, acceptances and sales of Data Instruments, Inc. products are subject to and shall be governed exclusively by the terms and conditions stated herein. Buyers acceptance of any offer to sell is limited to these terms and conditions. Any terms and conditions in addition to, or inconsistent with those stated herein, are hereby objected to and shall not become part of the contract. Data Instruments, Inc. acceptance of any offer to purchase by Buyer is expressly conditional upon Buyer's assent to all terms and conditions stated herein.

TITLE: Until such time as the purchase price is paid in full, title to the goods set forth in this document remains with Data Instruments, Inc.

COLLECTION: The Buyer expressly grants unto Data Instruments, Inc. a security interest in the said goods and the right to enter upon the Buyer's premises to repossess the goods without breaching the peace. Buyer shall be subject to any claim for deficiency balance. At its sole discretion, Data Instruments, Inc. may seek collection of purchase price through an action of law. Buyer shall defend and indemnify Data Instruments, Inc. for all costs and expenses of collection incurred by Data Instruments, Inc. Amounts not timely paid shall bear a late charge of $100.00 or interest at the rate of 1 1/2% whichever is greater, for each month or portion thereof that the buyer is late making payment.

DELIVERY: Unless otherwise provided on the front of this document, delivery shall be made F.O.B. Data Instruments, Inc. offices, which is the origin of goods. Regardless of the method of delivery, risk of loss shall pass to buyer upon Data Instruments'  delivery to carrier. Any delivery dates shown are approximate only and Data Instruments, Inc. is not liable for and will take no responsibility for any shipping related damage. Report all freight damage to the freight carrier immediately.

WARRANTY: Any claims for omissions or shortages in shipment shall be waived unless Data Instruments, Inc. receives notice thereof within 5 days after buyer's receipt of goods. At its sole discretion, Data Instruments, Inc. agrees to repair, replace or refund the purchase price of the goods which are found to be defective. Data Instruments, Inc. Limited Warranty terms and conditions are mailed with the sales invoice is located on our web site, http://www.workstation.net and available upon request. Data Instruments, Inc. makes no other express or implied warranties.

JURISDICTION: Seller and Data Instruments, Inc. consent to Jurisdiction and venue of the State and/or Superior Courts of Cobb County, State of Georgia only, for the purpose of resolving all issues of law, equity or facts arising out of or in supplementation or amendments to this document.

BUYER is responsible for returning all defective and warranty related items and is liable for the cost of all items, including shipping costs, not returned within ten days.

CREDIT CARD SALES: Data Instruments reserves the right to charge the Buyers credit card for all items shipped to and accepted by customer. Data Instruments reserves the right to charge the Buyers credit card for all parts shipped, working and non working to the Buyer.  Data Instruments reserves the right to charge the Buyer's credit card for any products not returned to Data Instruments within  (10) days including warranty and warranty replaced items.  Data Instruments will credit the buyers card if the items are returned within ten days and found to be defective by Data Instruments.

DATA INSTRUMENTS, INC. PURCHASE ORDER

Data Instruments, Inc. agrees to purchase the goods set forth on the front of this document under the following terms and conditions.

CONDITION OF GOODS: Seller warrants that the goods being purchased are in good working and cosmetic condition with all software media, operating systems, documents, complete cables, special tools, terminators and other items that would normally accompany the goods as defined by the manufacturer. If any such items are not part of the package, Data Instruments, Inc. may deduct the cost of the missing and/or non working items from the total purchase price.

MAINTENANCE: Seller will provide Data Instruments, Inc. with a letter from the manufacturer stating that the equipment is qualified for the manufacturer's standard maintenance agreement if so requested.

PACKAGING: The Seller warrants that the goods will be properly prepared for shipment and will be made available for delivery as noted on the front of this document.

TITLE: Seller warrants that at the time the goods are delivered, it will be the lawful owner of the goods, that the goods are free of any type liens, claims and encumbrances and that the Seller has the power and authority to sell the goods to Data Instruments, Inc.

RESPONSIBILITY: The Seller will be responsible for all costs associated with meeting the above requirements.

JURISDICTION: Seller and Data Instruments, Inc. consent to Jurisdiction and venue of the State and/or Superior Courts of Cobb County, State of Georgia only, for the purpose of resolving all issues of law, equity or facts arising out of or on supplementation or amendments to this document.
